Forms of Payment

All monies payable to a public trustee at any foreclosure sale under the provisions of this article or upon redemption or cure under the provisions of article 38* of this title shall be in the form of: 

  • Cash
  • Cashier's Check
  • Electronic Transer
  • Teller's Check

Cashier's Checks and Teller's Checks must be made payable to the Public Trustee and must also be issued by a financial institution as defined in section 15-15-201 (4), C.R.S.*, licensed to do business in the state of Colorado.

No Personal Checks are Accepted.

  • Total for a one page release: $28
  • Additional page: $5
  • To be applied to Fee and Expenses (C.R.S. 38-38-107[2]*)
  • Minimum deposit: $650
  • For amounts under $480,000: $150
  • For amounts over $480,000: 1/32 of 1%*

*Original Principal Balance or Outstanding Principal Balances of the Promissory Note - whichever is less

  • If all publications have been completed: $0
  • If not all publications have been completed: $75
  • Resale when sale held is violation of bankruptcy stay: $50
  • Public Trustee Withdrawal Fee: $35
  • Total Withdrawal: $35
  • Accepting intent to redeem from Lienor or Encumbrancer (owner exempt): $50
  • Total fee for a one page Certificate of Redemption: $41

Total for a one page Public Trustee Deed: $41

  • Recording documents: $13
  • Each additional page: $5

Note: A foreclosure is deemed open when the Notice of Election and Demand is recorded (C.R.S. 38-38-101[3])* and the fee is collectable at that time.
