WETLAND POND CONSIDERATIONS
- If intercepting ground water, you will need to file for a well permit with
the Colorado Division of Water Resources. The State requires an augmentation
plan to replace water lost through evaporation.
- Contact US Army Corps of Engineers for a permit. They will make an on site
inspection upon request.
Information required for site inspection:
- Legal description. Section, Township, Range & County.
B. Vicinity map in the county – so the US Army
Corps of Engineers can find the site.
- Identify the wetland in drawing. Show the location of the proposed pond.
Include the area of the wetland to be affected. Need area (sq. ft. or ac.)
of excavated area and area of spoil material or fill and where it will be
placed.
- In Boulder and Jefferson counties – You have to have a survey done by a
consultant to be sure that an endangered plant (Ute ladies’ tresses
orchid) is not present. The report needs to be sent to the US Fish &
Wildlife Service for their concurrence. Without the report, the US Army
Corps of Engineers will not issue a permit.
- If intercepting runoff, contact the Division I Water Court to see if
anyone has filled on that excess water.
