In every county, except the City and County of Denver, the Board of County Commissioners or their designee sits as the County Board of Equalization (CBOE) from July 1 until August 5 each year. During this time, the Board performs a dual role. They review the valuations for assessment of all taxable property appearing on the assessment roll of the County and hear individual taxpayers' appeals of the assessor's decisions.

The County Board of Equalization may add any omitted property to the tax roll, correct any errors made by the Assessor, and may raise, lower, or adjust any valuation for assessment to ensure that all valuations within the county are just and equalized. 39-8-102(1), C.R.S.

The CBOE meets on the second Monday in July, during which the Assessor reports the valuation for assessment of all taxable real property in the County. 39-8-105(1), C.R.S. The Assessor also submits a list of all persons who have protested valuations of real property and the Assessor's action in each case. 39-8-105(1), C.R.S.

On July 15, the Board receives the Assessor's report on the valuation of all taxable personal property in the County. The report includes the valuation for assessment of all portable or movable equipment which has been apportioned to the County. The Assessor submits a listing of those persons in the County who have failed to return declaration schedules and the action for each instance. The Assessor also submits a list of all persons who have protested valuations of personal property and the action taken. 39-8-105(2), C.R.S.

The taxpayer may appear before the CBOE in person or may be represented by an authorized representative. If desired, the taxpayer may choose not to be present and simply provide written documentation to the Board. The Assessor, or a representative of the Assessor, must be present at the hearing and present evidence to support the decision rendered during the protest period. 39-8-107(1), C.R.S.

The CBOE shall grant or deny the petition, in whole or in part, and shall notify both the petitioner and the Assessor in writing within five (5) business days of the decision. The County Board must conclude their hearings and render all decisions by August 5. The decisions must be mailed within five business days of the date of the decisions. 39-8-107(1) and 39-8-107(2), C.R.S.

If the taxpayer does not agree with the Board's decision he/she can appeal to the State Board of Assessment Appeals, County District Court, or a County Arbitrator. The appeal must be filed within thirty (30) days from the date of postmark of the decision letter.
