Objective: 1041 Regulation Review Schedule
Situation: The Agricultural Advisory Board has
requested a change in the 1041 Regulation review schedule to allow their group
time to review the draft. Planning staff attended their May 14 meeting and
briefly described the proposal, but AAB has devoted their agendas for May and
June to review of the NISP EIS. Their earliest date for 1041 review would be
July 9. Currently, a Planning Commission
hearing on 1041 is tentatively scheduled for July 16 (one week later).
Proposal: The Planning Dept. generally asked for
comments from affected interests on draft changes to the Land Use Code, reviews
those comments and proposed changeswith the
Commissioners and Planning Commission, and then schedules hearings on a
Proposed Code Amendment. In this case, we suggest moving forward with the
original schedule and asking the AAB to comment on the 1041 regulation prior to
the Planning Commission hearing, with those comments to be considered by the
Planning Commission at the hearing.
Advantages: The proposal will allow consideration of
1041 regulation final adoption by mid-August. The Planning Dept. as received
several inquiries about potential wind power plants and would like to have the
land use rules dealing with that use in place as soon as possible. Additionally, several county boards have
expressed interest in moving forward expeditiously with consideration of
designating additional activities of state interest beyond power plants and
electrical transmission lines.
Disadvantages: The current schedule would not allow
consideration of comments from the Agricultural Advisory Board prior to a
formal Planning Commission hearing.
Requested action: Provide direction on the 1041
regulation review schedule.
