PUBLIC HEARING REGARDING THE
PROPOSED LAND USE CODE

The Board of County Commissioners met at 1:30 p.m. with Larry Timm, Director of Planning, for a Public Hearing regarding the proposed Land Use Code. Chair Olson presided and Commissioner Disney was present. Commissioner Rennels was in California and participated via telephone conference call. Also present were: Al Kadera, Planner II; and Jeannine Haag, Assistant County Attorney. Recording Clerk: Gael Cookman.
Chair Olson noted that the first order of business would be to approve the Minutes from the October 19th and 20th Land Use Code meetings; she explained Commissioner Rennels would abstain from voting since she had not had a chance to read them.
M O T I O N
Commissioner Disney moved that the Board of County Commissioners approve the Minutes from the October 19 and 20, 1999 Proposed Land Use Code meetings.
Motion carried 2-0.
5.3.6.B.1 - USES IN RESIDUAL LAND
M O T I O N
Commissioner Disney moved that the Board of County Commissioners approve of combining the current Subsection 5.3.6.B.1.e with Subsection 5.3.6.B.1.b by inserting the following words: "Accessory structures must be appropriate to the use of the residual land as stated in the Management Plan." before the last sentence in Subsection b. And to add a new Subsection 5.3.6.B.1.e to read: "Residual land areas must not include road rights of way or parking areas, except in projects with a ratio of 20% developed area to 80% residual land the road right of way, up to 60 feet in width, may be included in the calculation of the required residual land area."
Motion carried 3-0.
5.3.6.B - USES IN RESIDUAL LAND

Commissioner Disney moved that the Board of County Commissioners approve of adding the following sentence to the end of Subsection 5.3.6.B.4: "Further division of these lots will not be permitted except as noted in Subsection 5.3.6.C.2 below."
Motion carried 3-0.
4.3.10.A - FARMSTEAD
M O T I O N
Commissioner Disney moved that the Board of County Commissioners approve of changing Subsection 4.3.10.A to read:
"Farmstead. That portion or portions of a farm, ranch, dairy, feed yard or poultry farm designated for uses and buildings which are accessory to the operation, including dwellings and equipment storage areas.
Motion carried 3-0.
9.1.3 - REQUIREMENTS FOR LAND DEDICATION
M O T I O N
Commissioner Disney moved that the Board of County Commissioners approve of changing the third sentence in 9.1.3 (the first unnumbered sentence) to read: "It must then recommend to the County Commissioners whether to require a dedication of land within the development; a payment of a fee-in-lieu of dedication based on the fair market value of the land; or a combination of both. And to change Subsection 9.1.3.D to read: "School Site Fees. Where a school site fee is required to be paid in lieu of dedicating land, the fee will be collected for each dwelling at the time the building permit is issued for the original dwelling.
Motion carried 3-0.
6.3.C - PROCEDURE
Commissioner Disney moved that the Board of County Commissioners approve of deleting "County Department of Natural Resources" from Subsection 6.3.C.
Motion carried 3-0.
TABLE 4 - USES IN ZONING DISTRICTS
M O T I O N
Commissioner Disney moved that the Board of County Commissioners approve of including Table 4 - Uses in Zoning Districts at the end of Subsection 4.1 as a cross reference for this section.
Motion carried 3-0.
M O T I O N
Commissioner Disney moved that the Board of County Commissioners continue this hearing to November 22, 1999 at 3:00 p.m. in the Commissioners Hearing Room, 200 West Oak Street, Fort Collins, Colorado.
Motion carried 3-0.
